The clearance outlet, at the back of the store, is packed full of clearance items, ranging from small appliances to furniture, clothing and utensils. NISBETS BRISTOL TRADE COUNTER SMS TERMS AND CONDITIONS OF USE
By registering to receive free SMS/MMS alerts for offers, product updates and news ("the Service"), you ("the Customer") will be taken to have read, understood and accepted these terms and conditions of use ("this Agreement") by Nisbets Plc, a company registered in England & Wales with company number: 01693112 and a registered address at 4th Way, Avonmouth, Bristol, BS11 8TB, United Kingdom ("Nisbets").
1. Service
The Customer is responsible for providing, registering and maintaining a digital cellular handset capable of sending and receiving SMS/MMS messages ("Phone") to receive the Service. To register for the Service, the Customer must contact Nisbets's Trade Counter in store or by calling 08451110285 to speak to a Nisbets representative who will register the Customer's details. The Customer warrants that he is the owner or legitimate user of the Phone which he uses to register for the Service, and is authorised to incur charges on the Phone. Nisbets does not charge for the Service however the Customer's network service provider may impose a charge for calls, receiving or sending SMS/MMS messages (including usage abroad), which shall be the Customer's responsibility.
2. Duration
The term of this Agreement commences from the time of registration of the Phone and remains in force until such time as the Customer unsubscribes from the Service.
3. Indemnities
Nisbets makes no warranties whether express or implied as to the accuracy, content, completeness or relevance of the information sent in performance of the Service. Nisbets shall not be liable to or through the Customer for any loss or damage whatsoever arising from the use of or inability to use the Service. The Customer agrees to indemnify, protect and hold Nisbets harmless against any loss or damage cause through use or misuse of the Services by any third party using the Customer's Phone during the term of this Agreement. Nisbets shall not be liable to the Customer for any error, delay or failure of transmission of the Service including errors or inaccuracies in the information transmitted.
4. Unsubscribing
The Customer may unsubscribe and terminate this Agreement at any time by texting 'STOP' to 07624805664. A final SMS will be sent by Nisbets to confirm the termination of the Service. Nisbets will not charge for stopping the Service however the Customer shall be responsible for any charge by his/her network service provider for the cost of the text message. If the Customer wishes to resume the Service then the Phone must be re-registered. Nisbets may withdraw the Service or terminate this Agreement by unsubscribing the Customer at any time without notice.
5. Confidentiality
Nisbets will store any personal information in line with the Data Protection Act 1998 and will not distribute the Customer's personal information to any third parties. The Customer is not allowed to publish, copy or re-distribute any data from the Service to any third party. The Customer agrees that any unauthorised use of data from the Service will lead to the immediate termination of this Agreement by Nisbets.
6. Jurisdiction
This agreement shall be governed by English law and the parties hereby submit to the exclusive jurisdiction of the English courts.
